Kids (Minor Child) Protection Plan
How can you plan and protect for your minor children should something happen to you?
The “Kids Protection Plan” is a plan to supplement your estate plan if you have minor children and address potential future issues should you become unable to care for them or pass away.
The idea that something could happen to you leaving your child without a set procedure for their care and protection is an understandable fear of every parent. It was this exact fear that led us to get our first estate plan and later decide to help other families plan for the unknown to protect their children.
Without a plan what happens to our minor children if I and the other parent become unable to care for them (incapacitated)?
Without a plan in place a well intentioned government official will take custody of your child until a suitable and appropriate caregiver can be located. In the interim your child(ren) may be removed from their home and in the custody of a state appointed caregiver.
For me, as a parent, the idea of my child ever touching the couch of a social workers office was unfathomable and I knew we had to find a solution to protect her. From there we established our own estate plan to address these fears and many other issues we didn’t even think of.
What does the “Kids Protection Plan” Do?
What happens to my minor children if I and the other parent become incapacitated?
Your identifying documents carried in your wallet can notify first responders that there are pre-selected caregivers (guardians) for your children and those persons can have orders in hand to authorize them to take custody of your children.
Minor children can avoid being introduced to well-intentioned government programs by having Guardianship elections in place and Guardians aware to enforce as needed.
Guardianship Selection (“Elections”)
Legal documents prepared and completed in which you nominate legal guardians for your child(ren) should you become incapacitated or pass. These provide for clear instruction and intention as to whom you have chosen to raise your children should both parents be unavailable. Provides options for government agencies to place your child(ren) with whom you have selected promptly, hopefully minimizing any time in government custody, and minimizing the need and costs related to court (absent someone challenging your selections).
Selected (“Elected”) Guardians have documents/resources
Pending your approval the elected guardians are notified and provided documents signed by you to utilize when/if such is needed (to avoid trying to find documents of which are put away in your home in a safe place) in order to take custody of your child(ren) promptly.
